Under the heading of "iOops"

Being involved with innovations and patents and getting new ideas turned into business opportunities, I can sympathize. Apple blunder gives Gates iPod royalty in today's online edition of The Independent.

You are, of course, correct that "prior art" may alleviate the Microsoft patent interference. GMSV has a good post referring to this at http://blogs.siliconvalley.com/gmsv/2005/08/_yes_microsoft_.html

Be that as it may, Apple will not win a patent either because of the same "prior art." Simply, as GMSV points out, you can't patent something that already exists and is, in fact, in market. So, at least this little part of the Apple iPod technology will be unprotected with a patent and hence not valuable from a licensing perspective. All of which means absolutely nothing in the real world where the iPod commands the lion's share of the market, I suppose.
